These Terms govern access to PixEverywhere, a social gaming brand operated by ActiveEdge.
1. Social game available on PixEverywhere
- Pixel Cascade
Pixel Cascade is developed by ActiveEdge and is provided for entertainment only. It does not offer or promote real-money gambling and does not provide cash, cash-out, monetary prizes, physical prizes or prizes of real-world value.
2. Age requirement
Users must meet the legal gambling age applicable in their Canadian province or territory before accessing the game. Access to Pixel Cascade is given only after you confirm this on the age check shown before the game. If you do not confirm it, access to the game is restricted. These Terms, the Privacy Policy, the Responsible Social Play page and the Contact page remain available without age confirmation.
3. Virtual currency, points and in-game items
Any virtual currency, points, credits or in-game items used in Pixel Cascade are for entertainment purposes only and have no monetary value. They cannot be redeemed, withdrawn, transferred, sold or exchanged for money or anything of real-world value.
4. Purchases
If Pixel Cascade includes in-app purchases, those purchases will be disclosed accurately on the landing page and described consistently in these Terms.
5. Acceptance of these Terms
By visiting pixeverywhere.com or playing Pixel Cascade you agree to these Terms, together with our Privacy Policy and Cookie Policy. If you do not agree, please do not use the site. We may update these Terms from time to time; the effective date at the top of this page shows when they last changed, and continued use after a change means you accept the updated version.
6. Licence to use the site
ActiveEdge grants you a personal, non-exclusive, non-transferable and revocable licence to access pixeverywhere.com and play Pixel Cascade in your browser for your own non-commercial entertainment. All rights not expressly granted are reserved by ActiveEdge.
7. Intellectual property
Pixel Cascade, its rules, code, artwork, names and text and the PixEverywhere logo are the property of ActiveEdge or its licensors and are protected by copyright and other intellectual property laws. You may not copy, modify, distribute, sell, lease, reverse engineer or create derivative works from any part of the site or the game except where applicable law allows it regardless of this restriction.
8. Acceptable use
You agree not to use the site in any way that is unlawful, that interferes with its operation or that attempts to gain unauthorised access to any system connected to it. You must not use automated tools to send messages through our forms, attempt to overload the site or misrepresent your identity when contacting us.
9. Forms
The contact form and the game development request form send the information you enter to ActiveEdge so that we can reply. Submitting a form does not create a contract for services. Any development work will be governed by a separate written agreement with ActiveEdge.
10. Availability and changes
We aim to keep the site and Pixel Cascade available but cannot guarantee uninterrupted access. We may change, suspend or withdraw any part of the site, including the game, at any time. Your best score is stored only on your own device, so we cannot restore it if it is lost when you clear browser data or change devices.
11. Disclaimer and limitation of liability
The site and the game are provided "as is" and "as available" without warranties of any kind, to the extent permitted by law. ActiveEdge will not be liable for any indirect, incidental, special or consequential loss arising from your use of, or inability to use, the site or the game. Nothing in these Terms excludes or limits liability that cannot be excluded under the law that applies to you, including the consumer protection laws of your Canadian province or territory.
